    SCOTUS pick: Sonia Sotomayor

A couple of observations. In the first quote from your post, you ask whether the issue of whether the test were fair. Under Title VII, that isn't the question (though I understand you were just wanting to set aside "legal lingo"). The question under Title VII is whether the exam was valid...

    SCOTUS pick: Sonia Sotomayor

Given that the hearings on the prospective new Justice will begin tomorrow, I thought it might be useful to initiate a discussion of a case that will likely figure prominently in the process . . . City of New Haven v. Ricci. Sotomayor sided with the City while she served on the Federal Court of...

    SCOTUS pick: Sonia Sotomayor

Love my Logans! And yes, I will even grant you the fact that Obama is not unmindful of the potential impact of the appointment for the election of 2012!

    SCOTUS pick: Sonia Sotomayor

I can agree with that, at least if you would accept two caveats. Her ethnicity, while certainly a factor, is not the sole reason she was picked. That she graduated at the top of her Princeton class (undergrad), her having been the editor of the Yale Law Review, and her long record of service...

    SCOTUS pick: Sonia Sotomayor

Actually, the statistic was offered, not to prove she was the right choice, but to rebut the earlier assertions that her "reversal rate" was out of the ordinary and indicative of her lacking the requisite competence for the job on the Court.

    SCOTUS pick: Sonia Sotomayor

During the 2006-2007 term of the Supreme Court, the % of reversals was in the high 60s, in the previous term the reversal rate was above 70%. Given the discretion the Court has over which cases it hears, perhaps it should come as no surprise that the mere act of agreeing to hear a case is a...

    SCOTUS pick: Sonia Sotomayor

One other observation . . . The original post describes her as a liberal activist judge. That characterization is similar to other statements I hear from politicians, particularly those on the right. For example, how many times have you heard a politician say that he doesn't want judges who...

    SCOTUS pick: Sonia Sotomayor

You indicate that Sotomayor will allow her "feelings and personal politics" to stand in the way of fairness. With all due respect, I suspect you know nothing of the legal issues that arose in the Ricci case. The City of New Haven administered an exam and no African-Americans passed. Under...

    Any E46 BMW Owners here?

My wife drives an '01 330i, and it has been relatively problem free. The only recurring problem has been the tendency of the power window motors needing replacement. Even so, she has just bought a 2007 Roush 427R to replace it  Thus, officially, the 330i is now F/S.

    McCain and Obama

The words of Martin Luther King, Jr. seem so utterly apt at this moment. "I have a dream that one day this nation will rise up and live out the true meaning of its creed: 'We hold these truths to be self-evident, that all men are created equal.'"

    McCain and Obama

I would offer the following rebuttal to your assertion that water-boarding is not torture: "Testifying before a House subcommittee on Nov. 8, 2007, Malcolm Wrightson Nance, a former Navy instructor in prisoner of war and terrorist hostage survival programs, explained that he experienced...

    McCain and Obama

Here is the exact quote: "CHENEY: Well, what we now have that's developed since you and I last talked, Tim, of course, was that report that's been pretty well confirmed, that he did go to Prague and he did meet with a senior official of the Iraqi intelligence service in Czechoslovakia last...

    McCain and Obama

I have followed this thread with great interest. I have until now been able to resist the temptation to weigh in, but this quote sent me over the top. To answer your question, and to irrefutably refute your assertion . . . On December 9, 2001, Vice President Dick Cheney asserted (on Meet the...

    Which Cruise line?

While I love the Disney concept, the premium you pay is just not worth it imo (and it is a pretty substantial premium). I, too, have always loved Princess (though I don't think they regularly offer cruises of fewer than seven days). In fact, we will be taking our 6th Princess cruise next March.

    Really good solo piano recordings

My favorite is Keith Jarrett - the Koln Concert (as in Cologne, Germany). A musical tour de force if there ever was one. http://www.amazon.com/Köln-Concert-Keith-Jarrett/dp/B0000262WI/ref=pd_bbs_sr_1?ie=UTF8&s=music&qid=1218255911&sr=8-1
