As it turns out, Congress still has, as granted by the Constitution, the right and power to issue "Letters of Marque and Reprisal".

This isn't the first time Ron Paul has suggested we use Letters of Marque to rein in external threats. In October 2001, he introduced bills H.R. 3074, Air Piracy Reprisal and Capture Act of 2001, and H.R. 3076, September 11 Marque and Reprisal Act of 2001, to authorize the U.S. State Department to issue such Letters. Private U.S. citizens would then be able to hunt down, attack and collect assets from terrorists who have or are planning to commit hostile acts against the U.S. and its citizens.

(I wonder, if when Representative Paul got up to read his proposals, did he say "House Resolution 3074", or did he say "Haych ARRRRRR 3074"? Now THAT would have been funny, I don't care who you are...)
